Legalization of Medical Marijuana in New York

In July 2014, Governor Andrew M. Cuomo and the New York State Legislature enacted the Compassionate Care Act to provide a comprehensive, safe and effective medical marijuana program that meets the needs of New Yorkers. This program was to ensure that medical marijuana is available for certified patients with serious conditions and is dispensed and administered in a manner that protects public health and safety.

Quantity of Marijuana

Under the Act, physician-authorized patients would be permitted under the state law to obtain up to 2.5 ounces of usable cannabis, purchased from state-licensed dispensaries. Smoking as a method of administration is prohibited by the Compassionate Care Act. Edible products are also not permitted.

Treatment of Illnesses in New York

By the Public Health law, the qualifying conditions are: cancer, HIV infection or AIDS, amyotrophic lateral sclerosis (ALS), Parkinson's disease, multiple sclerosis, spinal cord injury with spasticity, epilepsy, inflammatory bowel disease, neuropathy, and Huntington's disease. The associated or complicating conditions are cachexia or wasting syndrome, severe or chronic pain, severe nausea, seizures, or severe or persistent muscle spasms.

Licensing and Supply

The New York State is said to have one of the strictest Medical Marijuana Program of all 23 states that have legalized medical marijuana.New York State’s Medical Marijuana Program includes detailed products and dispensing label requirements, which may be found in regulations at NYCRR § 1004.11(k) and 10 NYCRR § 1004.12(h). Registered organizations are also required to provide a department-approved package safety insert to patients when dispensing medical marijuana.On Jan. 7, 2016, the medical marijuana program officially launched with 8 dispensaries statewide.
